Auto accident with police car – 920,000.00

A police officer was speeding enroute to a burglary in progress in a wooded area when he broad-sided a passenger truck, injuring the driver and killing his wife. We immediately filed a lawsuit and obtained a Protective Order from the court directing the police department to preserve the recorded radio transmissions between the officer and the dispatcher. Those recordings revealed that the burglary did not involve any threat to persons on the premises, and there was no emergency other than the potential loss of property. The officer’s rate of speed was not justified under the circmstances.

Police shooting – 315,000.00

An off-duty police officer was working as a bouncer when he was asked by one of the bar’s doormen to place a patron under arrest, allegedly because the patron had kicked him during a dispute. The off-duty officer told this individual that he was under arrest, but did not handcuff which enabled the individual to run. The officer ran after the patron and a struggle ensued. As the officer attempted to hand-cuff his subject, a crowd of bystanders gathered to watch when our client, not knowing that the bouncer was a police officer, attempted to push the bouncer off his friend. The officer pulled his gun and the weapon fired, striking our client in the neck. The officer claimed that the shooting was accidental. The officer admitted, however, that his finger was on the trigger even though he had no intention of firing his weapon. Most police departments around the country have a “finger off the trigger until ready to shoot” policy designed to prevent accidental shootings.

Grocery store slip and fall – 250,000.00

A 48 year-old woman was grocery shopping with a friend for her husband’s surprise birthday party when she slipped on ice and water, causing her to twist her knee. At the time, a store employee was icing the produce and spilled crushed ice on the floor. Our client had previously injured the same knee only four months before this accident, resulting in damaged cartilage. The grocery store incident aggravated her bad knee, causing further damage to the cartilage which required arthroscopic surgery followed by a total knee replacement three months later. The medical testimony revealed that our client would have eventually needed a total knee replacement anyway even absent the grocery store incident, but the accident accelerated the process.

Wrongful arrest for shoplifting – 25,000.00

We listed this one because we wanted readers to know that sometimes its not always about the money sometimes it’s a matter of principle. A 41 year-old man was shopping at a well known home-improvement and hardware store when he was accused of stealing a drill-bit costing $1.98. Our client explained to the security guard that he had previously purchased the drill-bit at another store and was only using it to compare drill-bit sizes. Our client had the receipt for the drill-bit inside his car in the parking lot, but the security guard refused to go with him to his car to retrieve the receipt and instead called the police. Our client was arrested and incarcerated for only a few hours before being released. The hardware store subsequently failed to appear in court and the charges were dismissed. This was not a “big money” case, but our client wanted justice for the violation of his rights and we were honored to represent him.
